Member Code of Conduct

The following Code of Conduct sets out the terms and conditions under which the Cannabis Growers of Canada (“we”, “us”, “our”) permit your use of the interactive services of this website (the “Website”).

By accessing and posting to the forum and any other interactive sections of the Website (the “Services”), you: (a) unconditionally agree to be bound by and to comply with this Code of Conduct; and (b) represent and warrant that you are a member of the Cannabis Growers of Canada in good standing over the age of majority in the province or territory in which you reside (“Member’) and have been authorized access to these Services by us.

1. Your Use of the Services

As a condition of your continued access to and use of the Website and Services, you agree to abide by all applicable federal, provincial, territorial and other laws.

Commercial posts are prohibited unless prior approval has been obtained.

All posts must be in either English or French.

Any attempt to obtain unauthorized access to any portions of this Website that you are not authorized by us to access is strictly prohibited. If you are an authorized Member and have reason to believe that your account is being used by another person, notify us immediately.

When using the Services, you agree not to:

  1. upload, post, e-mail or otherwise transmit any material that:
    1. constitutes unsolicited or unauthorized advertising, promotional materials, or any other form of unauthorized solicitation;
    2. infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
    3. infringes on the privacy, personality or other similar rights of any person, living or deceased;
    4. is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; or
    5. contains any form of destructive software such as a virus, worm, Trojan horse, time bomb, cancelbot, or any other harmful components or any other computer file, program or code, designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;
  2. harvest or otherwise collect or store any information (including personally identifiable information) about other users of the Website and Services, including e-mail addresses, without the express consent of such users;
  3. for the purpose of misleading others, create a false identity, user profile, or otherwise manipulate identifiers in order to disguise the origin of any post or material transmitted through the Website;
  4. attempt to gain unauthorized access to the Website, or to restricted areas of the Website, or other computer systems or networks connected to the Website, through password mining or any other means; and
  5. interfere with or disrupt networks or servers connected to the Website or violate the regulations, policies or procedures of such networks.

2.  Our Responsibility for Content and Monitoring

We are not obliged to, but reserve the right to monitor the content posted to the Website and the Services from time to time to verify adherence to this Code of Conduct and/or applicable law.  We reserve the right, in our sole discretion, to reject, refuse to post, remove, amend or block access to any content that is posted to the Website at any time, without notice and without liability.

If you become aware of any activity or content posted on the Website or Services which you reasonably believe to be in contravention of the law, of this Code of Conduct, or which infringes on the rights of any third party, please contact us at: contact@cannagrowers.ca

We reserve the right to limit your access to the Website, and/or to terminate your Membership, in the event that we determine in our sole discretion that your activity on the Website and/or use of the Services violates this Code of Conduct.

3. Limitations of Liability

The Services are provided as a convenience only for Members to communicate about issues impacting licensed medical marijuana growers in Canada.  We shall not be responsible or liable in any way for the accuracy, quality, completeness, usefulness or availability of any information transmitted or made available on or through this Website or the Services. In addition, we shall not be responsible or liable in any way for any errors or omissions in any information transmitted or made available on or through this Website or the Services. Before using or relying on any content, you should take reasonable steps to verify its accuracy, quality, completeness or usefulness: you are using it at your own risk.

Views and opinions expressed by Members on the Website do not necessarily represent our views or opinions, or the views or opinions of our Members.  We do not recommend or endorse any specific products, services, opinions or other information that may be posted on or through the Services or any third party website to which you can link from this Website.

4. Indemnity

You agree to indemnify us (and our officers, directors, employees, and representatives) and hold us harmless from any and all claims and expenses, including attorney’s fees, arising from or relating to: (i) any content that you contribute to this Website and/or the Services; (ii) your use or misuse of this Website, the Services or any content; (iii) any person’s use of any account or password provided to you in relation to this Website, regardless of whether such use is authorized by you; (iv) any breach by you of any of the Website Terms of Use or this Code of Conduct; and (v) any breach by you of any law or regulation or any rights of any third party.

5. Changes to this Code of Conduct

We reserve the right to modify this Code of Conduct at any time without prior notice. When we modify the Code of Conduct, we will notify Members by email to the email account provided at the time of registration, and will post the updated version of the Code of Conduct on this Website together with the date on which it was revised.
